A South Elgin man has been charged in a fatal accident that occurred last October near the intersection of Route 47 and Corneils Road in Yorkville.
Kendall County officials have charged Kyle A. Delhaye, 21, of the 1500 block of Exeter Lane in South Elgin, with two felony counts of aggravated unlawful use of an electronic communication device.
According to state law, an electronic communication device includes but is not limited to “a handheld wireless telephone, a handheld personal digital assistant, or a portable or mobile computer.” If the use results in the death of a person, it is a Class 4 felony, which could lead to a sentence of between one and three years in state prison, according to state law.
Ashley Lopez, 23, of the 400 block of Abe Street, Plano, was killed when the vehicle she was riding in was struck from behind by a vehicle driven by Delhaye near the corner of Route 47 and Corneils on Oct. 11, 2016.
Lopez was a passenger in a 2008 Nissan Altima stopped in traffic in the northbound lane of Route 47 when a 2016 Chevy Silverado pickup truck driven by Delhaye struck the rear bumper of the Nissan, causing both vehicles to leave the road, police said.
Lopez was pronounced dead after being transported to Advocate Good Samaritan Hospital in Downers Grove.
Delhaye was initially cited for failure to reduce speed to avoid an accident. Selma Martinez, 56, of Plano, the driver of the Altima, and Angela Lopez, 22, also of Plano, another passenger in the Altima, were taken to Rush Copley Medical Center in Aurora for treatment of their injuries.
