BREAKING: Mom, stepdad charged with involuntary manslaughter in death of Boulder Hill girl

YORKVILLE – A Mendota man and woman were arrested and charged with manslaughter for the death of a child, who was found unresponsive in their Boulder Hill home last month, according to Kendall County Coroner and Sheriff's Office officials.

Sheriff's detectives arrested James A. Davidson, 29, and Courtny A. Davidson, 32, both of the 800 block of Washington Street in Mendota, on Thursday, Aug. 6 afternoon and charged both in connection to the death of 6-year-old Kerrigan Rutherford, according to a Thursday joint news release from the Kendall County Coroner's Office and sheriff's office. The Kendall County State’s Attorney’s Office approved one count of involuntary manslaughter, which is a Class 3 felony, and two counts of endangering the life or health of a child, also Class 3 felonies, against both adults.

If convicted, the two adults could face up to 15 years in prison each.

Kendall County Sheriff's Dep. Dan Briars confirmed on Thursday that Courtny Davidson was Kerrigan's mother and James Davidson was Kerrigan's stepfather.

The update comes after sheriff's deputies initially responded to a call at about 1:28 p.m. July 2 in the 100-block of Boulder Hill Pass in Boulder Hill for a child reportedly unresponsive and not breathing. Sheriff’s deputies and Oswego Fire Protection District personnel found 6 year-old Kerrigan Rutherford dead inside the residence.

A joint investigation with the sheriff's office and coroner's office began shortly after Kerrigan was found. An autopsy was conducted on July 2, which included multiple toxicological tests, according to the joint release.

Based on these tests and information gathered during the two month joint investigation, Kendall County Coroner Jacquie Purcell ruled the cause of death to be prescription drug toxicity and the manner to be homicide.

Both adults are currently in custody at the Kendall County Jail and awaiting bond call 1 p.m. Friday afternoon at the Kendall County Courthouse, according to the coroner's and sheriff's offices.

Courtny Davidson's mug shot was not immediately available for publication as of about 6 p.m. Thursday.
